A character-specific pose, used as part of the characterization, and used repeatedly by the original artist (the one who attributed the pose to the character) is a "stock pose", not a swipe. McFarlane introduced some new poses to Spider-man and he should be credited for that. But it also means that other artists on the character cannot be accused of swiping when they use it.
Ironically, in order to claim that the image above by JB was a "swipe" as opposed to a legitimate "stock pose" one would have to deny McFarlane's tremendous influence or impact on the physical characterization of Spider-Man.
