I am fully opposed to the death penalty as I think it is "Cruel and Unusual Punishment" and thus prohibited by the Eighth Amendment.

Considering how many countries have death penalties and how many societies throughout history have had death penalties, how can you consider it Unusual? (I am willing to concede Cruel).

Based on the AP report it looks like a big win for the NRA.  Not so good for the Police

Why would you say that? The DC murder rate and overall crime rate will likely drop significantly.

I can't agree with that until I've read the decision and see the basis for it.  I was thinking of it politically first.

If it's circumstantial evidence, then I don't believe the death penalty is right.  If there is indisputible DNA evidence, photographic/video evidence, etc. I have no issue with it.

I hope you are right.  I tend to think, however, the easier the access to guns, the greater the supply leading to more guns on the street, never a good situation for the police.

I'm not sure how much difference it makes to the police.

Here in the District, you can walk to Virginia if you really want to. And it's easy as pie to get guns there. I don't think very many of the criminals with guns got them or kept them legally anyway, so it's not like this will make it easier for criminals to get guns.

And the DC firearms laws weren't even that easy to prosecute. You had to prove that the handgun worked in order to convict someone for possession of it. I doubt there was that much utility in being able to arrest someone for possession of a firearm when you can't prove the other crimes you suspect him of.

Based on Amnesty International figures 60 countries have the death penalty, 137 have abolished it in law or practice.  Moreover, 88% of the reported executions in 2007 took place in: China, Iran, Saudi Arabia, Pakistan and the United States.  Among the countries we tend to identify with we are virtually alone in the use of the Death Penalty. 

History is not a persuasive argument to me on human rights issues.

The problem I have, is that child molesters are no longer put in the general jail population. My cousin who is a guard at a prison up in northern Indiana is very frustrated. They have a seperate area for child molesters and he said it is the most peaceful section of the jail. He feels they just do their time and get tips from other offenders. They are also seeing more repeat offenders.

But the general population sounds like hell, he was so shocked at how bad it was. Don't put the molesters to death, that's too easy, stick their asses in with all criminals, I would think it would be a bigger deterrent if they knew they were going there.

I agree that with mistakes in the criminal justice system we have more then likely sent innocent men and women to their death.  I do find that troubling.

The reason they seperate them is if they mix them with the general population it's a death sentence.  Even other criminals hate child molesters.

So Jodi, you and I are in complete agreement.  Mix 'em in.
