I still fail to understand why people think that someone should go to jail for making something that others consider "obscene".

The obscenity exception to the First Amendment is one of the great bastards in the history of Supreme Court decisions. 

What is it about "Congress shall make NO law" that is so confusing?

Seems like much ado about nothing.  Has he authored any cases on obscenity?  I fail to see how having these images on his, ahem, hard drive could color his analysis of cases not dealing with obscenity.*

*And even if they colored his views in an obscenity contest, so what?  Judges all bring personal opinions and philosophies to the bench.  Would anyone object to a Catholic considering a case against a parish at which he was not a parishoner?

Maplethorpe is a good example Tom.  Of the art he created that I saw there was little that, ahem, spoke to me.  But I don't think it should be banned and I don't find it obscene.  I think with some that I saw you can fairly ask where the line is drawn between erotic art and pornography, but I don't want porn banned either.  I wouldn't want public funds used for Maplethorpe's art but I don't want any public funds spent for any non-commissioned art.  That said if a museum, even a publicly funded museum, wants to show it -- more power to them.  I just won't be attending the exhibit.

I wasn't terribly familiar with Maplethorpe's stuff until I saw a gallery book on him recently.  If it makes you feel any better, Geoff, his stuff didn't do all that much for me, either. 

Penises, penises, penises... I get it.  And Georgia O'Keefe is obsessed with vaginas...
