To answer Geoff's question - what if your insurance won't pay? Then you can, thanks to this bill, easily and affordably switch to another insurance. Free market and all... But that doesn't solve the problem of them denying coverage Mike -- and I would wager thats a problem that more americans share than the inability to purchase insurance. My point was I think this is a First Down -- not a touchdown.

Geoff, that's part of my concern as well. People will be forced to buy insurance but the insurance companies may not necessarily pay for the particular treatment(s). I'm for smaller government but it would provide some reassurance if there was actual regulation to prevent such incidents from still occuring and enforcement of those policies.

Thats sounds like the opposite of most state laws! Usually there is a presumption that the lead car was not at fault. Although, as described here, the presumption may be overcome and the lead driver can be held liable.

The reason I think it's a step in the right direction is pretty simple. I believe it's easier to change and add to an existing law, than it is to make a new one from nothing. I just hope that this isn't the end and some real change occurs pronto.

Geoff, I don't think you're understanding what I'm saying.Yes, Blue Shield can say, "no, we're not going to pay for your treatment." And as of last week, you were screwed. But now, you have more freedom to shop around - Blue Shild tries to screw you, go to Aetna, or Blue Cross or Kaiser or whatever.

But my mother did not have insurance and the other woman did.

And what I was speaking about, mostly, was payments of claims when you have insurance. I understand that now one can buy new insurance after a denial and the "pre-existing condition" exclusion won't be applicable -- per se -- but I don't have any faith that insurers will do anything other than collect premiums. Don't get me wrong, I think its a decent first step, time will tell if its a good first step.
