Within the context of the books, isnt 'Capes' meant to be somewhat derogatory or dismissive.  I mean there was just a massive war between heroes that were for and against a government sponsored registration act?  Why wouldnt the government in that context be leery of superheroes.

What about Ultras or Marvels? Those always seemed pretty stupid to me.

I had never thought about the discrepancy in capes between the two publishers.  Interesting.  Kind of.

Dependant on which incarnation we're discussing, that might be true. When I read the Hawkman showcase, they made it pretty clear that the first thing the Hawks did when they landed on Earth was to present their credentials to local law enforcement. This certainly suggests that they were "legal" aliens. And in some Martian Manhunter stories, especially post crisis, MM seems to be very involved with the United Nations. It is a possibility that he has acquired some sort of UN / Diplomatic visa.

I think it's fair to say that in the DC universe someone must have adressed the issue of legal residence for Space Aliens. I don't really think we need a maxi-series about the INS recruiting supervillains to hunt down and deport superheroes who are illegal aliens. (Oh, wait, it's M****l that does that kind of stuff. My bad.)

I was under the impression that the term 'capes' was not one for us the reader to use, instead it is for the more cynical and jaded imaginary citizens and bad guys of the Marvel and DC universe. It is a term of mild abuse rather than another name for a superhero. I don't really understand how this is much of a problem to be honest. Superheroes always have enemies after all.

Yell "IMMIGRATION!!!!" at a JLA meeting and see who runs for the teleporter.

Since I happen to have Hawkman's Silver Age origin handy I can tell you Commisioner Emmett makes a phone call to his brother and "fixes it" for Katar and Shayera to take his place (and home) as curator of the Midway City Museum andsets them up with false IDs.  Far as I can tell only Emmett and his brother are aware of "Carter and Sheira Hall's" alien status. Ah for a simpler time
