It doesn't look like a trace at all, and every position ends up different (where it ends up in space). To me that is totally fine.

It’s not a trace, but it’s still a swipe. Sometimes, in fact, I catch myself “swiping from memory”. A drawing is coming too easily, so I pause and think about it. Oops! I realize I’m seeing someone else’s drawing in my mind’s eye. Erase and start over!

It seems like there is only so many poses per situation that an "accidental" swipe would occur from time to time.

It seems like there is only so many poses per situation that an "accidental" swipe would occur from time to time -- It seems like there would be many never chosen because they look awkward and that everyone would hone in on the most dramatic ones.

A few years back I found myself having to DEFEND Rob Liefeld, when someone accused him of swiping a Ron Garney Captain America. Maybe, I said, but also keep in mind that there are only so many ways of drawing Cap running straight at the camera! Especially if we want the shield turned toward the viewer.

I work with stock photography all day in my job as an illustrator. If you're going to use a royalty-free reference, check the license. Some places, like Shutterstock, require no credit. When you download a photo from Dreamstime, the first thing that pops up is a window with the artist name telling you to be sure to credit the artist. Check the license, if you want to reference something you download royalty-free make sure you don't have to put any credit on it. That makes it easier to create a reference and piece together photos if you need that as your initial sketch for an illustration.

For my final issue of NEW VISIONS I drove around taking pictures of the various 21st century locations I needed. For the 20th century backgrounds I built images from license-free shots I found online, mostly construction and demolition sites. When I’m drawing the scenes, I can mostly fake it. New York street scenes, I can go generic. Chrysler Building©, I pull reference.

That Facebook swipe page Andy referred has a lot of posts of supposed "swipes" that are really just similar looking poses, etc.
It's funny, when the JB Deadman/Iron Fist picture was posted a few weeks ago, some people were acting like it was some great "gotcha" moment. It seems there are always those people looking for some perceived "wrong" to bring down someone they are jealous of, or dislike for some reason.
Many young artists swipe, especially when they are learning to draw. That Deadman swipe is pretty darn early in JB's career. It's not the same as how Rob Liefeld, Greg Land, David Mack, or even Fabio Laguna (anyone remember him?) used swipes to fill out entire issues, or used swipes well into their professional careers.

It's funny, when the JB Deadman/Iron Fist picture was posted a few weeks ago, some people were acting like it was some great "gotcha" moment. It seems there are always those people looking for some perceived "wrong" to bring down someone they are jealous of, or dislike for some reason.••• Since I’ve never been shy about faults I see in the work of others—and my own—there are those who see great victories in “catching” me out. Even when I’ve pointed out the same things myself.
