Yes, he's insane.  They are not going to execute him.  DC wants the character alive. I just don't think it's Batman's place to decide.  When I first got on the net I started reading this theory and shook my head.  Far as they were concerned Batman was responsible for the people the Joker killed because he refused to kill him.
