The problem is that Obama is thrusting upon Congress a modicum of maturity and responsibility and, sadly, they aren't up to the task.

All Obama has to do is NOT APPEAL. Here is a great article by David Mixner (a gay activist who used to be Clinton's roomie in law school -- someone I actually KNOW!) talking about it. Obama, which side are you on?

Obama Administration appeals DOMA rulingThis is a bit surprising, not that they appealed, but that they did it before the elections. The administration is trying to have it both ways - they say they think the policy is discriminatory and should be repealed, but yet they are still challenging it.

That links to an article about the Obama administration appealing the DOMA rulings, not DADT.

My bad, but the Justice Dept. is also looking into appealing the ruling by another judge regarding DADT.

Can someone tell me how the process works, if Obama appeals it, does it then go to a higher court? Will it eventually get before the supreme court? Point blank, the law just needs over turned or voted to be illegal. I don't like issues like this being decided from the bench. Just as a liberal judge can make it go one way, a conservative judge can make it go back the other way. But to be honest at this point I will take what we can get.
But seriously how completely torturous this back and forth must be for gay families. One minute you are legal, next you aren't and so on and so on. It is complete bullshit. And to me the government is emotionally terrorizing a percentage of it's population.

Bishop Jackson is after Tom's marriage in DC... There is no ground for him to appeal on, even to the Supreme Court. I don't understand this, other than the man just can't lose with dignity.

****
An appeal from the Federal district court to the circuit court of appeals. The next and final step would be to the US Supreme Court, if they allow an appeal.
NYTimes reports that the DOJ will appeal the injunction.
>>...the Justice Department plans to appeal a federal court order that the military immediately stop enforcing the law that is used to drum out gay service members once their sexual orientation becomes known. [...] Defense Secretary Robert Gates said the policy should not be lifted abruptly because there are unresolved questions like whether straight and gay soldiers should share barracks and whether the military should pay benefits to partners of gay service members. He said he wanted to wait until a review of practices and policies was submitted on Dec. 1.<<
