I believe in federalism and as a matter of principle I try to resist joining in the chorus of "state's rights" bashing.  I love the concept of the states being "laboratories of democracy".  However, I think history has shown that it is the states that have abused this privilege. 

I think it is clear that the founders thought that the concept of the states as laboratories of democracy meant that the they would act to EXPAND freedom in the face of a fairly weak and limited federal government.  Remember the heated debates over the Bill of Rights --- where some delegates feared that enumerating a set of rights would actually act to LIMIT people's freedoms.  The states turned this this on its head when they began passing laws to limit freedoms. 

The inevitable outcome of this was a bloody civil war and radical expansion of federal power to remedy these abuses.

Victor,

How far off would you say Mexico is from making gay marriage legal throughout the entire country?  Or is marriage there a state issue as it is here in the United States?

Added: To our many UK'ers on this forum,

It's been a few years since the UK declined to legalize same-sex marriage and instead opted for Civil Partnerships (known as Civil Unions or Domestic Partnerships here in the US) --- any thoughts on how satisfied people are with this dual arrangement?  Do gay and lesbian couples feel disenfranchised by the "separate but equal" nature of the laws?  Any chance your compromised Lib Dems could force the Conservative Party into finally passing marriage-equality?

Very far, Marc. It's more a religious issue than a civil or politic issue.

Catholic church is behind the actual government and there are several controversies asking the banning of the law that allow gay couples to marry and adopt here in Mexico City. Catholics are trying to make people afraid that god might get angry for this "degenerated" laws.

It will take a real deep change in society -or from right to left in the government- to get that in the whole country.

The funny part is that most people is OK with same sex marriages.

Not only lovely Argentina has approved Same-Sex Marriage....Washington DC won't ban Same-Sex marriage a.l.a. Prop8 in California. That means that Musculars Tom & Eric will be married for a long time!

Answering your questions Marc...My husband and i did travel to Buenos Aires some years ago, and from one hand you have an Argentinian society quite open to stuff related to gay stuff. A society that also enriches itself by the Gay Tourism. Lots of places and options for gay. What i have seen, aside from reasons of religion or political, are issues of economy and find ways to boost them.

So, some cities have approved marriage because it's a human right in the agenda of our modern society, but also as a way to boost tourism. Argentina has a more oppressive Roman Catholic Church than Mexico, and they did approve it. Mexico is not far from it, but we are suffering the same as USA, our marriages laws are in state constitutions, so every state in the country defines marriage. We will have to live what you are right now, see marriage approved in one state and not in another.

My marriage with my husband is recognized in Mexico City, and in the cities of USA that recognizes it. Not on a federal level, in both countries.

And on your other question, what sounds better "you are invited to our civil union ceremony" or "you are invited to our wedding"???...

BTW...a couple of weeks ago i did visit Vincent in San Clemente, CA. for 4th of July celebrations...we had a great time. I'll visit him again in a month, more or less...

One down, many more to go.  Hopefully this will be a domino effect.  It's a bit difficult for the church over there to be making any statements about this being immoral, considering the trouble they're in.

Girl is awarded $35K over canceled prom.

Remember this case about the girl who wanted to bring her girlfriend to her prom but the school district wound up canceling the prom rather than let her attend?  Looks like that case is now closed.  The monetary award seems a bit much, but sometimes if you really want to hit someone where it hurts, that spot is usually their bank account.
