There is always hope. The ballot measure itself is a vote for discrimination. Eight = Hate. If Eight is passed it becomes a legal question -- specifically does this measure violate the equal protection clause of the US Constitution? Remember that state constitutions cannot be more restrictive than the United States Constitution but the issue of Gay Marriage (and specifically the ban on gay marriage as a violation of equal protection) has not be addressed by the Supreme Court (or any Federal Court I am of which I am aware). Should the measure pass there is a federal question* which can be challenged in Court. Its not as gratifying as an electoral rebuke of the hateful agenda that is fueling Proposition Eight, but it is a measure of hope.
*I think there may already be a Federal Question as it pertains to civil union status and equality under the law specifically regarding the assessment of taxes to same sex couples that are "legally bound." To that end a question to Tom: I know you and Eric are married but are you legally joined? Did you and Eric have to file any legal papers or pay any fees for your union?

To that end a question to Tom: I know you and Eric are married but are you legally joined? Did you and Eric have to file any legal papers or pay any fees for your union?
Geoff, it has all the love of a business arrangement, but yes. We are now "business partners" in essence, with combined bank, mortgage, etc.

Is that state initiated or privately? Do you know what I mean? Does DC have a civil union law? Do you need like a license or state filing to be joined?
