I don't think for one second Anthony owes Byrne any money.
Ditton does and I'll ask Ar this: If Byrne took Ditton to small claims court,
would he get a judgement in his favor? I say yes! |

I suspect you're right, Eric. I do know I'd be loathe to actually sell Ditton
the piece at this point if I were JB, but it would at least make the matter
of payment owed go away.
Edited because I stupidly keep assuming my posts are going to
appear right underneath those they're in response to...

Mike, what other message boards?Lets see... IMWAN?
**********************************************
Anthony, I didn't say anything about IMWAN or any other boards at all. True, in the first 2 pages of this thread I correctly surmised that this drama was all unfolding on IMWAN, but that's not because I've been reading it - I haven't - but because that seems to be where people go when they want to crow about having "gotten over" on JB somehow. No great detective work there. Indeed, I wonder if the very existence of such a place, where one can easily find a willing, receptive audience to such tales might encourage these kinds of schemes to be cooked up. But that's all supposition.

JB, now that you heard our opinions, what do you think about all this?

It's amazing the lengths that some of you will go to the justify, excuse and rationalize unethical behavior. Mr. Castrillo has admitted he was wrong -- even if his apology has been shrouded in a sullen, defensive and victimized tone. Yet some of you are still determined to clear him of any culpability. He knew he was blatantly copying the work of an artist who had not been paid for his work. Pretty clear to me.

Why was JB's offer to change the commission to the buyer's taste rejected?

Gerry - I don't know what I ever did to you that you would put my name in quotes (?!) or call me a troll. I've asked some questions in this thread, I guess that could be called "trolling" for answers, but it's just because as an outsider I'm ignorant of how many of these artistic/ethical decisions come into play and as a comic book fan it interests me.

I believe it was because the change required whiteout.

"but it would at least make the matter of payment owed go away."-Al
Ditton owes monies to JB, regardless of JB giving Ditton the original art!
Because Ditton commissioned a "tracing" of the first he haseffectively said "I want this piece!" Wich is the exact opposite of what he said to JB's art dealer.
-IF- JB gave this piece to Ditton for the same price as the original commission, Ditton would be receiving a courtesy from John as as it stands now. Ditton is indebted to the original artist.

Which he has admitted to.
It does not make him guilty of the original theft, however.
