I remember that pic.
And I remember the guy who had it re drawn.
He said he liked the pic, but that he'd specifically asked for the Negabands when he commissioned it. He didn't want the wrist laser which was from a couple of panels in an old Avenger's comic.
He asked that it be fixed, and when you was refused, he hired someone else to do what he asked for.
He also said he'd been banned around the time you posted the drawing, so he really didn't see the point in lining your pockets.

Hard to believe that that was refused, I remember  when  you first showed it and thought it was wonderful. 
I'm not sure what you can do about the swipe.  I guess the only thing you can do is what you did and hope the truth tells the story.
It really is one of your better commissions, great idea and execution.

That is theft of intellectual property.

A commission is not just the artwork, but the basic design and concept of the piece. If I hired a landscape architect to design my yard, told her I was unpleased with the work, refused payment, and then planted according to her specifications with a slight tweak here and there, I should expect to be sued. I don't know what recourse there is available, but this fellow has benefited from John's intellectual and physical labours without providing compensation, and that isn't right.

Questions for John: How much back-and-forth is there between you and the customer before you start work on a commission? And if upon review of the work the commissioner had asked you to "correct" the piece to add the wristbands, would you have been able to do so?

If so, that's good reason to refuse the commission.  That doesn't even remotely excuse getting another artist to trace Byrne's work.  At least get the new artist to draw his own version. 

Fuck that guy.

I agree with you on that front.

But let me add this.
Isn't the whole idea of doing commissions of copyrighted characters in that strange "gray area" of legality? So one guy steals from another guy who's kinda on the "gray" side.
