Not real.  He'd be to powerful with his version of cosmic awareness to know who's been naughty and who's been nice, along with the ability to be all over the world in an evening.

I prefer not real - a real Santa in a fake world would make for a logistical nightmare, unless the Santa thing were the main thrust of that world.  Mainly because you can't trust future writers to show restraint.

Catching up...

- Penguin over the Riddler (although neither is Batman's second-best villain, in my book. In fact, I'd take R'as, Two-Face and Poison Ivy over either of them.)

- Santa should be imaginary in the comic book world. And he should be real in the real world.

- Spider-Man has the better origin (shocking that I would pick Spider-Man, I know).
