Equinox could be the "let's call in reserve Avengers to deal with this guy" kinda guy. Empath could be the "how come we just kicked each other's asses??" kinda guy.

Going with Equinox cause Empath couldn't stand up to a Reed or Cap keeping their cool in the midst of a fight. One punch and he's out.

Empath - he's the stuff super-villains are made of, while Equinox really was a good one-of story but someone ELSE with a different personality would have to become Equinox II to really step into a "major super-villain" role. (of course, these days, ANY character can have a different personality if the writer doesn't bother to do research)
