Isn't Greg Land the artist who was pretty much busted for tracing other people's work instead of just referencing it, to swipe poses and panel layouts? Or am I thinking of someone else?

I got over the fact that comic artists use photo reference to different degrees.  If the end product is enjoyable, I really don't care if they took a snapshot of their neighbors reenacting Tarzan and the mangani's attack on Opar and traced it.

Hats off to Bradstreet and the artists from Ex Machina for broadcasting their work process.  I looked through an Ex Machina trade and saw that they published the posed photos that they use as reference.  Looks like they photograph most of the comic before they begin to draw it.  If you get the Punisher DVD, you'll see Bradstreet showing his step-by-step work process, including his tracing of the posed photo by use of a light table.  Again, the end product works, so I'm not complaining.

There are still folks out there that believe it is ok to alter copyrighted photographs in Photoshop (no matter how derivative) and try to pass it off as their own work.

I don't do that Dan, but to be honest if the artist takes it far away enough from the original image that he makes it his own I don't have too much of a problem with that.

Technically it is breach of the architect's copyright to photograph his building but people generally don't get their knickers in a twist if you do.

I speak by the way, as one who has had her own work reproduced without permission in the past.
